RESOLUTION SETTING A HEARING TO VACATE
A PORTION OF MAPLE STREET, MAP OF P. HAZEN’S
ADDITION TO TAWAS CITY, A RECORDED PLAT, CITY OF TAWAS CITY, IOSCO COUNTY, MICHIGAN
At a regular meeting of the City Council of City of Tawas City, County of Iosco, State of Michigan, held on the 20th day of July 2026, at 6 pm Eastern Daylight Savings Time at Tawas City Hall, 550 West Lake Street, Tawas City, Michigan.
PRESENT: Brad Huebel, Chuck Klenow, Dave Lesinski, Jerry Malone, Ed Nagy, Mike Russo, and Jackie Masich
ABSENT: None
WHEREAS, a request was made for vacating a portion of Maple Street in Tawas City, generally described as the protion of Maple Street that extends to the north from the north side of Cedar Street to the north side of the vacated Pine street, and is 49 1/2 feet wide lying east of losts 4 and 5, block 10 in the Map of P. Hazen’s Addition to the CIty of Tawas City, a recorded plat;
and
WHEREAS, the Tawas City Planning Commission has made a recommendation to the City Council to vacate the street.
NOW, THEREFORE, this Council having considered the matter fully, it was moved by Council Member Russo and supported by Council Member Klenow:
- That this Council does deem it advisable to vacate the portion of Maple Street that extends to the north from the north side of Cedar Street to the north side of the vacated Pine Street, and is 49 1/2 feet wide lying east of lots 4 and 5, block 10 in the Map of P. Hazen’s Addition to the City of Tawas City, a recorded plat, excepting and reserving unto the city a permanent easement for drainage described as:
Commencing 39 1/2 feet west of the southwest corner of lot 4, block 7, of P. Hazen’s Addition to the City of Tawas City, a recorded plat,
as recorded in Liber 2 of Plats, Page 5, Iosco County Records, thence north to the Tawas River, thence west 10 feet, thence south to the
north line of Cedar Street, thence 10 feet east to the Point of Beginning.
2. That this Council does hereby declare its intent to vacte the portion of Maple street as described above and subject to the reservation as provided herein, and does hereby direct the City
Clerk to publish a Notice of Hearing of vacation of said street, at which time the Council will meet and hear objections thereto.
3. That the CIty Clerk is derected to publish this Resolution together with the Notice incorporated herein in the Iosco County News-Herald for two (2) consecutive weeks prior to the
date of the hearing:
NOTICE OF PROPOSED VACATION
Take notice that the City Council of the CIty of Tawas City will meet and hear comments regarding the proposed vacation of that portion of Maple Street that extends to the north from the north side of Cedar Street to the north side of the previously vacated Pine Street, and is 49 1/2 feet wide lying east of losts 4 and 5, block 10 in the map of P. Hazen’s Addition to the City of Tawas City, a recorded plat, except for a reservation for utilities described in a resolution declaring the proposed vacation.
The hearing on vacation of the street shall be held on August 10, 2026, at 6 pm as Tawas City Hall, 550 West Lake Street, Tawas City, Michigan.
Comments regarding the proposed vacation may be filed with the City Clerk in writing or parties may appear at the hearing and comment orally.
4. That, if objections are filed, the street or any portion thereof shall not be vacated or discontinued except by a concurring vote of two-thirds of the City Council.
5. That all resolutions and parts of resolutions in conflict with this resolution are hereby repealed.
